Well now … she, her husband, and the child are all American Citizens, are they not? She, her husband, and her child are bound by American law.
She broke the law.
How exactly did she “save” the child? Was he abusive? If so, why did the court protect his parental rights? Maybe because he’s done nothing wrong, other than get divorced? In that case, American law says that he is just as responsible for the child as she is, and has just as much right to the child as she does.
The rule of law trumps “common sense” and religious tradition … as it SHOULD in a modern democracy. So under “common sense” and “Jewish religious law,” the father has no rights whatsoever when it comes to his children?
When the Soviets tried to prevent Jewish emigration, we protested. A Jew, however small, has a right and an obligation to live in Eretz Israel. The mother’s actions to that end are halachically legal and righteous.
If a woman would have taken her child from America to any other country but Israel, I would agree with your reasoning.
This is preposterous. What this woman did is nothing short of kidnapping. It doesn’t matter whether she took the child to Israel or Disney World, you can’t just grab your kid and go without the consent of the child’s other parent.
To imply that this is somehow sanctioned by religious law and that it is therefore okay is ridiculous. The Torah also says that children who are disrespectful to their parents should be stoned to death. Would you really defend a child murderer on these grounds?
If a religious court sentences his child to death for religious transgression of disrespect (a highly unlikely event), then he cannot be considered a murderer. Besides, it is the community rather than a parent who carries out the sentence.

Your logic is lost on me. First you are saying that the father should have no rights, because of something a country did to the Jews. Next you are saying if it where any other country but Israel you would agree that the father should have rights. So if the Muslims had the same law, you would not be ok with this? Really you can’t not pick and choose. Are you ok with all religious laws coming before country laws or not?
I’m only okay with Jewish religious law coming before Israeli secular law, let alone the law of any other country.
